THE OFFICIAL RULES FOR THE MONTHLY CENTEX LOYALTY MEMBERS SWEEPSTAKES AT CENTEX (the “Sweepstakes”)

 

OFFICIAL RULES (the “Official Rules”)

The MONTHLY CENTEX LOYALTY MEMBERS SWEEPSTAKES is sponsored by 650273 Alberta Ltd. (the “Sponsor”).  The Sponsor in its sole and absolute discretion may engage certain third parties to administer various aspects of the Sweepstakes on its behalf.  In these Official Rules, the term “Sponsor” includes those third parties.

NOTE: NO PURCHASE IS REQUIRED TO PARTICIPATE IN THE SWEEPSTAKES, AND MAKING SUCH A PURCHASE WILL NOT INCREASE OR AFFECT A PARTICIPANT’S (DEFINED BELOW) CHANCES OF WINNING A PRIZE (DEFINED BELOW) IN THE SWEEPSTAKES.  GO TO RULE 3.a.ii FOR INFORMATION RESPECTING HOW TO PLAY OR ENTER WITHOUT A PURCHASE.

GENERAL RESPECTING TERMS USED IN THESE OFFICIAL RULES:

In these Official Rules, a person who is eligible to participate in the Sweepstakes is referred to as a “Participant”.

The Sweepstakes is open only to residents of the provinces of British Columbia, Alberta, Saskatchewan, and Ontario who are eligible to participate in the Sweepstakes, as described in Rule 2.a below.  Except as otherwise specifically stated in these Official Rules, all times mentioned in these Official Rules are “Local Time”, which refers to the time of day at the location of a particular Participant in the province in which they are resident.  The period during which a Participant can participate in the Sweepstakes is called the “Sweepstakes Period” and is defined in Rule 3.b below.

The Sweepstakes is divided into three (3) zones where a Prize is awarded (individually, a “Zone”, collectively the “Zones”).  Zone 1 contains residents of the Province of Ontario.  Zone 2 contains residents of the Provinces of Alberta and Saskatchewan.  Zone 3 contains the residents of the Province of British Columbia.

A “Sweepstakes Number” is a 12 digit, unique alpha numeric code provided to each entrant.  As described in these Official Rules, it is necessary for a Participant to have a Sweepstakes Number to claim a Prize.  The term “Prize” refers to the monthly prizes available to be won by the Participants.  The term “ARV” means the approximate retail value of the Prize and does not include applicable taxes, if any.  Note that all ARVs and other dollar values in these Official Rules are stated in Canadian dollars unless otherwise stated.

The term “Sweepstakes Material” means, without limitation, any Sweepstakes number, any document such as the declaration and release (a “Declaration and Release”) as well as any other documents which the Sponsor, in its sole discretion, requires a Participant to complete and provide in order to properly claim a Prize.  The term “Prize Claim Process” means completing the instructions on how to claim a prize.

The term “Loyalty Member” means a participant in the Centex Rewards Cash Program, as defined in the Terms and Conditions of the Centex Rewards Cash Program, as amended from time to time, available at https://centex.ca/fleet-program.  The term “App” means the Centex Rewards app available for download on Google Play and the Apple App Store.

The term “Loyalty Transaction” means a purchase at a participating Centex location in which a Loyalty Member either swipes their Centex Rewards Card, or presents their barcode from the App at the time of said purchase.

The term “Business Day” means a day on which banks are open for business in Alberta, but excludes Saturday and Sunday and statutory holidays in Alberta.

NOTE: SUBJECT TO THE PROVISIONS OF THESE OFFICIAL RULES, BEFORE ANY PARTICIPANT WHO IS A POTENTIAL WINNER OF A PRIZE IN THE SWEEPSTAKES CAN BE DECLARED A WINNER OF A PRIZE, THEY MUST FIRST CORRECTLY ANSWER A MATHEMATICAL SKILL-TESTING QUESTION (the “SKILL-TESTING QUESTION”), WITHOUT ASSISTANCE OF ANY KIND, WHETHER ELECTRONIC, MECHANICAL OR OTHER.  THE SKILL-TESTING QUESTION WILL BE PROVIDED TO POTENTIAL WINNERS OF PRIZES IN THE MANNER SPECIFIED IN THESE OFFICIAL RULES.

OFFICIAL RULES AND THE SPONSOR’S DECISIONS BIND PARTICIPANTS:

The Sweepstakes are being conducted in the provinces of British Columbia, Alberta, Saskatchewan, and Ontario by the Sponsor in accordance with these Official rules.  By participating in the Sweepstakes, each Participant, unconditionally accepts and agrees to comply with and abide by these Official Rules (which are available for review at participating Centex locations in the provinces of British Columbia, Alberta, Saskatchewan, and Ontario, and online at centex.ca/cashback) and by the decisions of the Sponsor with respect to the Sweepstakes, including, without limitation, the meaning and application of these Official Rules, which decisions shall be final and binding upon all Participants with respect to all aspects of the Sweepstakes.

NOTE:  IF ANY PARTICIPANT IS DETERMINED TO BE NON-COMPLIANT WITH THESE OFFICIAL RULES, SAID PARTICIPANT SHALL BE DISQUALIFIED.

  1. GENERAL DESCRIPTION OF THE SWEEPSTAKES

To participate in the Sweepstakes, a Participant must obtain a Sweepstakes Number in the manners described below in these Official Rules (refer to Rule 3.a below).  Within one week following the end of each and every month during the Sweepstakes Period, the Sponsor will select two random winners from each Zone in the manner described below in these Official Rules (refer to Rule 6 below).

NOTE:  A PARTICIPANT MAY RECEIVE A MAXIMUM OF SEVENTY-FIVE THOUSAND DOLLARS ($75,000) WORTH OF WINNINGS. 

The Sweepstakes Period begins on October 1, 2024 and continues until terminated by the Sponsor in accordance with these Official Rules.  Refer to Rule 3.b below for additional information concerning the planned Sweepstakes schedule.

  1. ELIGIBILITY 
  1. Who Can Play:

Subject to the provisions of the Official Rules, including, without limitation, the restrictions on eligibility set out in Rule 2.b below, the Sweepstakes is open to all Loyalty Members who are legal residents of the Provinces of Alberta, British Columbia, Ontario, and Saskatchewan, and who have reached the age of majority in their province of residence at the time of entry.

Participants are prohibited from participating in the Sweepstakes for a purpose other than entering the Sweepstakes for the Participant’s own personal benefit.

  1. Restrictions On Eligibility: Individuals Who Are Not Eligible To Participate In The Sweepstakes:

Persons in any of the following categories are not eligible to participate in, or to win a Prize in, the Sweepstakes:

  1. Any person who, on or after October 1, 2024, was or is a director, officer, employee, member, manager, agent or franchisee of the Sponsor or any one or more of the Sponsor’s divisions, parents, subsidiaries, affiliated companies, franchisees, advertising and promotional agencies, representatives, service agencies or independent contractors;
  2. Any individual engaged in the development, production or distribution of Sweepstakes Material;
  • Any person who is or purports to be an immediate family member (defined as spouse, dependent for federal income tax purposes, half-sister, half-brother, or step-, biological, foster, in-law or adoptive mother, father, sister, brother, daughter or son) of, or who resides or is domiciled in the same household as, any person in any of the preceding categories; and
  1. Any person who has already won seventy-five thousand dollars ($75,000) from the Sponsor during the Sweepstakes Period. 
  1. HOW TO ENTER THE SWEEPSTAKES 
  1. How To Obtain a Sweepstakes Number 

As described below, a Sweepstakes Number can be obtained at a participating Centex location within one of the Zones with each Loyalty Transaction, or a Participant can obtain a Sweepstakes Number without purchase.

A Participant may obtain Sweepstakes Numbers from multiple Zones by completing a Loyalty Transaction, as described in Rule 3.a.i below, within multiple Zones.  Participants obtaining a Sweepstakes Number using the AMOE, as described in Rule 3.a.ii below, will receive a Sweepstakes Number eligible for the Zone in which their mailing address, as provided, is located.

  1. How To Get A Sweepstakes Number With A Loyalty Transaction: 

A Participant will receive one (1) Sweepstakes Number by purchasing any item as part of a Loyalty Transaction at a participating Centex location during the Sweepstakes Period.

The Sweepstakes Number received will be placed into the pool of Sweepstakes Numbers of the Zone in which the participating Centex location is located.

The Sponsor reserves the right to limit the daily amount of Sweepstakes Numbers provided to a Participant, acting reasonably.

In the event that a participating Centex location is unable to provide a Sweepstakes number, for any reason whatsoever including, but not limited to, technical difficulties, a Participant may present proof of the Loyalty Transaction to the Sponsor to receive a Sweepstakes Number.

  1. How To Get A Sweepstakes Number Without Making A Purchase: 

A Participant has an alternative means of entry into the Sweepstakes (the “AMOE”).  A Participant can request a Sweepstakes Number, without completing a Loyalty Transaction, by mailing a request (a “Request”) as follows:

  1. The Request must be mailed in a postage-paid outer envelope;
  2. The Participant’s complete return mailing address must be included on the outer envelope;
  3. The Participant must include a copy of the Participant’s Loyalty Member Centex Rewards Card;
  4. Within the outer envelope there must be one self-addressed envelope that uses the Participant’s complete mailing address;
  5. The self-addressed envelope must bear sufficient return postage; and
  6. The outer envelope must be mailed to: Centex Loyalty Sweepstakes Number Request, #203, 1717 10th Street NW, Calgary, Alberta, T2M 4S2.

Each request must be mailed in a separate outer envelope (i.e. only one Request per envelope).  The Sweepstakes Number provided to the Participant using the AMOE will be part of the pool of Sweepstakes Numbers drawn from for the month in which the outer envelope was actually received at the above address, unless said date is within three (3) business days of the end of the month, in which case the Sweepstakes Number will be part of the pool for the succeeding month.  Both the mailing and return addresses on the exterior envelope must be legible.  Envelopes with no return address on the outside will not be honoured.  Requests that fail in any way to comply with the requirements set out above in this sub-paragraph or that are not mailed separately (i.e. only one Request per outer envelope) bearing sufficient postage will not be honoured.  One Sweepstakes Number will be mailed in response to each Request that complies with these requirements.  The outer envelopes bearing the Requests must be postmarked no sooner than October 1, 2024, and must be actually received at the above address no later than the last Business Day of the month in which the Request is to be entered, to allow adequate time for processing.

  1. The Sweepstakes Schedule 

Sweepstakes Numbers will be available at participating Centex locations in Alberta, British Columbia, Saskatchewan, and Ontario beginning on or about October 1, 2024, and continuing until the Sponsor discontinues the Sweepstakes (the ‘Sweepstakes Period’).

  1. Transfers Of Sweepstakes Numbers 

Any transfer, whether by way of sale, loan, gift, handover or any other manner whatsoever, of any Sweepstakes Materials, including without limitation, a Sweepstakes Number, by an ineligible person to an eligible person is strictly prohibited.  The transfer by a Participant of any Sweepstakes Materials, including without limitation, a Sweepstakes Number, to any other person is strictly prohibited except if a Participant who is the winner of a Prize wishes to transfer the Prize to another person, subject to these Official Rules that transfer must be authorized expressly in writing by the Sponsor before the transfer is made, and such authorization may be granted or withheld in the Sponsor’s sole discretion.

A Participant must make any request for such authorization in writing, must sign that request, and must mail the written and signed request along with their Sweepstakes Number when submitted to the Sponsor.

  1. PRIZE 

There will be two (2) Prizes available in each Zone every calendar month during the Sweepstakes Period.  Each Prize consists of TWO HUNDRED and FIFTY CASHBACK DOLLARS ($250.00) applied to the Participant’s loyalty account.

The Prize must be accepted as awarded.  A Prize is not transferable or convertible to cash.  No substitutions will be made, except at the Sponsor’s option.  The Sponsor reserves the right, in its sole and absolute discretion, to substitute the Prize or a component thereof with a prize of equal or greater value, including, without limitation, a Centex Gift Card.

The ARV of a Prize, or any substitution thereof, is TWO HUNDRED and FIFTY DOLLARS ($250.00).

  1. ODDS OF WINNING 

The odds of winning depend on the total number of entries received in each Zone.  Obtaining one Sweepstakes Number makes you eligible for the prize drawing.

  1. WINNER SELECTION AND NOTIFICATION 

Within two (2) Business Days following each calendar month during the Sweepstakes Period (the “Draw Dates”), two (2) Sweepstakes Numbers from each Zone will be selected by random draw from among all Sweepstakes Numbers within each Zone obtained in the preceding month.  The odds of winning depend on the number of Sweepstakes Numbers obtained in each Zone.

A Participant may obtain Sweepstakes Numbers from multiple Zones, as explained in Rule 3.a above.

The Sponsor will display the winning Sweepstakes Numbers from each Zone in the App and on the Sweepstakes Website within two (2) Business Days of the end of each calendar month during the Sweepstakes Period.  The selected winners must contact the Sponsor within seven (7) Business Days of the winning Sweepstakes Number being posted.  If the Participant holding the selected winning Sweepstakes Number does not contact the Sponsor within seven (7) Business Days, then the selected Sweepstakes Number will be disqualified (and the Participant will forfeit all rights to the Prize) and the Sponsor reserves the right, in its sole and absolute discretion, to randomly select an alternate winning Sweepstakes Number from the remaining Sweepstakes Numbers (in which case, the foregoing provisions of this selection shall apply to such new selected entrant.)

  1. SWEEPSTAKES WEBSITE 

There is no online Sweepstakes or online method of entering the Sweepstakes.  Use the browser on your phone, tablet, or a computer to go to the Sweepstakes Website to access:

  1. The Official Rules; and
  2. The Winning Sweepstakes Number.

While all efforts are made to support current browsers, operating systems and devices, new operating systems, browsers and devices may not be supported if brought to the market after the development of the Sweepstakes Website.  The Sponsor is not responsible for any browser, operating system or device supporting issues.

  1. PRIZE CLAIM REQUIREMENTS AND DEADLINES 

Important Notes About Winning a Prize in the Sweepstakes: 

Skill-Testing Question:  Before any Participant who is a potential winner of a Prize in the Sweepstakes can be declared a winner of the applicable Prize, subject to the provisions of these Official Rules, they first must correctly answer a mathematical Skill-Testing Question without assistance of any kind, whether electronic, mechanical or otherwise.

Forfeiture:  If, for any reason, a Prize is forfeited, then the applicable Prize will not be awarded and the potential Prize winner will not have any claim against the Sponsor or against any other person, firm or corporation in respect of the Prize or any matter related to the Sweepstakes.

  1. General Information For Prize Claim: 

Eligibility Requirement For Claiming a Prize: 

In order to claim a Prize, the Participant must be the age of majority in their province of residence as of the date the Prize is being claimed.

The Age of Majority for the following provinces is eighteen years old: Alberta, Ontario, and Saskatchewan.

The Age of Majority for the following province is nineteen years old: British Columbia.

  1. Claiming a Prize and Prize Claim Deadline: 

If a Participant holds a winning Sweepstakes Number, as posted in the App and on the Sweepstakes Website, they must contact the Sponsor by email within seven (7) Business Days of the Sponsor posting the winning Sweepstakes Numbers.  Failure to email the Sponsor within this timeframe will result in forfeiture of the Prize.

Notice of possession of a winning Sweepstakes Number must be sent to loyaltygift@centexpetroleum.com.

  1. Being Declared a Prize Winner: 

Upon receiving the email as described in Rule 8.b above, the Sponsor will provide a follow-up email to the Participant. Before being declared a confirmed prize winner, the selected Participant will be required to:

  1. Correctly answer a mathematical skill-testing question without assistance of any kind, whether electronic, mechanical, or otherwise; and
  2. Sign and return, within three (3) Business Days from the day the Sponsor provides the follow-up email mentioned above, the Sponsor’s declaration and release form (the “Release Form”) which:
    1. Confirms compliance with these Official Rules;
    2. Acknowledges the Participant’s acceptance of the Prize as awarded;
    3. Releases the Releasees (as defined in Rule 9 below) from any and all liability in connection with this Sweepstakes, the Participant’s participation therein, or the awarding and use or misuse of the Prize or any portion thereof; and
    4. Agree to the publication, reproduction, and other use of the Participant’s name and address (City and Province) without further notice or compensation, in any publicity or advertisement carried out by or on behalf of the Sponsor in any manner whatsoever, including print, broadcast or the internet.

If the selected Participant:

  • Fails to correctly answer the Skill-Testing Question;
  1. Fails to return the properly executed document as specified above in the specified time; or
  2. Cannot accept the Prize for any reason,

then the Participant will be disqualified and will forfeit all rights to the Prize and the Sponsor reserves the right, in its sole and absolute discretion, to randomly select an alternate, random Sweepstakes Number from among the remaining eligible Sweepstakes Numbers.

 

NOTE:  Subject to the provisions of these Official Rules, Participants should not show or give any Sweepstakes Numbers to any Centex employee.  Centex employees cannot verify any Sweepstakes Numbers or award any Prize.

  1. General Requirements for Prize Verification:

All Sweepstakes Numbers, Declaration and Releases and Sweepstakes Materials are subject to verification in the App.  Sweepstakes Numbers are null and void and will be rejected if the Sponsor finds that they were not obtained through authorized, legitimate channels.  “Legitimate channels” do not include purchasing or obtaining Sweepstakes Numbers online or at live auctions, or by any unauthorized transfer by sharing a Sweepstakes Number or Sweepstakes Numbers.  If any part of any Sweepstakes Number is counterfeited, or if any Sweepstakes Number is illegible in whole or in part, washed, erased, mutilated, eaten, damaged or tampered with in any way, the Sweepstakes Number will be rejected and will be deemed void and invalid.  As is noted above in the section “Official Rules and the Sponsor’s Decisions Bind Participants” (before Rule 1), each Participant acknowledges and agrees that the decisions of the Sponsor shall be final, binding and conclusive in all matters relating to the Sweepstakes, including, without limitation, determinations regarding a potential Prize winner’s eligibility to win a Prize and the validity, state or status of Sweepstakes Numbers submitted for verification.  Any person attempting in any way to forge or alter any Sweepstakes Number or other Sweepstakes Material in an apparent attempt to defraud or mislead the Sponsor in any way in connection with the Sweepstakes will be prosecuted to the fullest extent permitted under the law.  In the event of a dispute as to the identity of a potential Prize winner, the Potential Prize Winner will be deemed to be the Loyalty Member whose Centex Rewards Card was used to obtain the Sweepstakes Number.

If a Prize winner makes any false statement in any document related to the Sweepstakes, such winner will be required to promptly return to the Sponsor upon demand the Prize(s) or, at the Sponsor’s option, the cash equivalent of the Prize(s) based on the ARV as stated in these Official Rules.

  1. Delivery of Prize 

Within two (2) weeks following the satisfactory completion of the conditions specified in Rule 8.a to 8.d above by both the Sponsor and the winning Participant, the Sponsor will provide the Prize to the winning Participant.

  1. GENERAL LIABILITY AND PUBLICITY RELEASES AND CONDITIONS OF PARTICIPATION 

Participants assume all risk of loss, damage, destruction, delay and misdirection of Sweepstakes Materials, including without limitation, Sweepstakes Numbers.  The Sponsor is not responsible for illegible, misdirected, late, lost, damage, incomplete, stolen or postage-due AMOE submissions which may be judged void; for any damage to a Participant’s computer system or wireless device which is occasioned by accessing or using the Sweepstakes Website or App; for lost, interrupted, inaccessible, incompatible or unavailable networks, servers, satellites, internet service providers, wireless carriers, websites (including at the Sweepstakes Website) or other connection; for availability or accessibility problems arising in connection with or over the course of the Sweepstakes or any matter related to the Sweepstakes; for miscommunications, failed, jumbled, scrambled, delayed or misdirected computer, telephone or cable transmissions, or hardware or software malfunctions, failures or difficulties; for any technical malfunctions, failures or difficulties, printing errors or omissions, clerical, typographical or other errors or omissions in any Sweepstakes Materials; for any errors or omissions or failures of any kind whether human, mechanical, clerical, electronic, interruption of power or technical in nature or other; or for the incorrect or inaccurate capture of information, or the failure to capture any information.

By participating in the Sweepstakes and claiming a Prize, each Prize winner hereby releases and agrees to hold the Sponsor and their respective parent companies, subsidiaries, affiliated companies, divisions, advertising and promotional agencies, franchisees, independent contractors, representatives and services agencies (the “Releasees”), and every director, officer, employee, agent, manager and member of any one or more of the Releasees, harmless from and against any and all costs, injuries, losses or damages of any kind, including, without limitation, death, bodily injury and property or other damage or loss, due in whole or in part, directly or indirectly, to participation in the Sweepstakes or in any activity related to the Sweepstakes.  Participants waive the right to assert as a cost of winning any Prize, any and all costs of certification and redemption or travel to claim said Prize and any liability and publicity which might arise from claiming or seeking to claim said Prize.  By participating in the Sweepstakes, except where legally prohibited, each verified winner hereby agrees and grants to the Sponsor the right, but not the obligation, to use their name, along with their address (City/town and Province) and any statements made by or attributed to such winner in any and all media (including the Internet), now known or hereafter devised, in perpetuity and throughout the universe, for advertising and promotional purposes in connection with the Sweepstakes and other of the Sponsor’s promotions, and any future or other consent, sweepstakes, game, or promotion of the Sponsor or competition or communication about any future or other contest, sweepstakes, game or promotion of the Sponsor without future notice, review, approval or compensation, and releases the Releasees and every director, officer, employee, agent, manager and member of any one or more of the Releasees from any and all liability with respect thereto.

    1. Disqualification: 

It is each Participant’s responsibility to ensure that they have complied in full with all of the conditions and requirements contained in these Official Rules.  The Sponsor reserves the right in its sole discretion to disqualify any individual who is found to be tampering or interfering in any way with the operation or conduct of the Sweepstakes, to be acting in violation of these Official Rules, or to be acting in unsportsmanlike or disruptive manner, in the opinion of the Sponsor, acting reasonably, or with the apparent intent to disrupt or undermine the legitimate operation of the Sweepstakes or to annoy, abuse, threaten, or harass any other person.  The Sponsor reserves the right to seek damages and other remedies from any such person to the fullest extent permitted by law.

  1. Force Majeure/Printing and Production Errors or Omissions: 

Subject to any governmental approval that may be required, the Sponsor reserves the right, without prior notice and at any time, to terminate the Sweepstakes, in whole or in part, or to modify, suspend or extend the Sweepstakes in any way.  Without limiting the generality of the foregoing, subject to any governmental approval which may be required, the Sponsor reserves the right, without prior notice at any time, to terminate the Sweepstakes, in whole or in part, or to modify, suspend or extend the Sweepstakes, if it determines, in its sole discretion, that the Sweepstakes in any way and for any reason is impaired or corrupted or that fraud or technical problems, failures or malfunctions (including, without limitation, computer viruses, computer system overload or any other kind of electronic or other overload, glitches, or printing or production errors or omissions) have destroyed or severely undermined the proper play, integrity or feasibility of the Sweepstakes.  In the event that, in the Sponsor’s sole opinion, the Sponsor is impeded or prevented from continuing with the Sweepstakes as planned or intended by any event beyond its control, regardless of when such event commenced, including, but not limited to, fire, flood, natural or manmade epidemic or crisis, pandemic, earthquake, explosion, labour dispute or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, terrorist threat or activity, war (declared or undeclared), any federal, provincial, territorial or local government law, order or regulation, public health crisis, the order of any court of jurisdiction, or by any other cause not reasonably within the Sponsor’s control, then subject to any governmental approval that may be required, the Sponsor shall have the right to modify, suspend, extend or terminate the Sweepstakes.  Subject to the provisions of these Official Rules, only the type and quantity of Prizes described in these Official Rules will be awarded in the Sweepstakes.

  1. Invalidity 

The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision.  In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Official Rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.  Headings and captions are used in these Official Rules solely for ease of reference, and shall not be deemed or considered to affect in any manner the meaning or intent of these Official Rules or any provision hereof.  These Official Rules cannot be modified or amended in any way except in writing by a duly authorized representative of the Sponsor.  Subject to the provisions of these Official Rules, employees of the Sponsor, or of any of its franchisees, are not authorized to modify, amend or waive these Official Rules.

  1. Governing Law

Subject to any provision expressly to the contrary in these Official Rules, all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules or the rights and obligations as between one or more Participants and the Sponsor in connection with the Sweepstakes shall be governed by and construed and interpreted in accordance with the federal laws of Canada, and in accordance with the internal laws of the Province of Alberta, including the procedural provisions of those Alberta laws, without giving effect to any choice of law or conflict of law rules or provisions that would cause or bring about the application of any other jurisdiction’s laws.  All Participants, the Sponsor, and all other parties hereby attorn to the jurisdiction of the courts of the Province of Alberta, sitting in the City of Calgary, in respect of the determination of any matter or dispute arising under or in respect of the Sweepstakes or these Official Rules and agree that any such determination shall be brought solely and exclusively before such courts in the Province of Alberta.
